Scott A. Dietterick
The JSDC Law Offices is led by James Spade and Scott A. Dietterick. This group handles virtually all aspects of real estate law, including: purchase, sale and financing transactions; commercial and residential land development; real estate lending; corporate, and tax aspects of real property transactions; commercial leasing, landlord and tenant enforcement matters; zoning and land use; real estate brokerage matters; condominium and other property owner’s associations; and real estate loan workouts.
The firm, through lawyers both within and outside the Real Estate Law Group, also has extensive litigation experience involving a wide range of real estate-related issues, including: contractual disputes, title, boundary and access issues, mortgage foreclosures, problems arising in bankruptcy; and mechanics’ liens and other construction disputes.
The primary clients of the Real Estate Law Group include real estate development companies, real estate lenders, commercial and industrial facility owners and individuals. The real estate development companies range from entrepreneurial residential builders to commercial developers. Real estate lending clients include banks, savings and loan associations, and mortgage bankers. The Real Estate Law Group also handles many and varied residential and non-residential real estate transactions for clients of the firm whose primary business is not real estate.
Land Use and Land Development
Our attorneys have handled a broad range of land use and land development issues involving residential, agricultural, commercial and industrial properties and uses. This practice includes representation of clients before local, state and federal governmental unites and regulatory agencies and in court proceedings. the firm’s zoning practice has included pursuing or opposing all forms of zoning relief, including variances, special exceptions, conditional uses and changes in zoning. The firm’s land development practices includes commercial, industrial and residential subdivision and land development, including residential condominiums and planned communities. Our clients’ properties and projects are located in rural, suburban and urban communities and environments.
Leasing
We represent lessors and lessees in a full range of leasing transactions, including industrial, office, retail, general commercial and residential.
Real Estate Lending
We advise institutional lenders regarding general real estate lending policies and represent them in negotiating and making real estate loans, including major commercial loans for commercial, industrial and residential projects. Our lawyers also handle mortgage foreclosure actions and other lender enforcement proceedings and arrange, for lenders and borrowers, workouts of loans for properties that are not performing as they should.
Purchases, Sales and Other Transfers
The firm routinely represents buyers and sellers of virtually all types of real property and interests in real property, including commercial, industrial, agricultural, recreational and residential. A significant portion of the firm’s work is performed on behalf of industrial corporations who are not in the real estate field as such, but whose businesses actively involve them in substantial real estate transactions or in asset and stock transactions involving ownership and operation of real property. The attorneys in the Real Estate Law Group cooperate with other firm attorneys and provide assistance when real property issues arise during representation of the firm’s clients in other practice areas.
